Upkid, Inc. ("Upkid," "we," "us," or the "Company") respects your privacy and is committed to protecting it through this Privacy Policy. This Policy describes how we collect, use, disclose, and safeguard personal information when you access or use Upkid’s websites, mobile applications, and related services (collectively, the "Platform").
This Privacy Policy applies to all users of the Platform, including Applicants, Customers, and Providers (as defined in the Terms of Use).
1. Scope and Relationship to Terms of Use
This Privacy Policy is incorporated into and forms part of Upkid’s Terms of Use. Capitalized terms not defined here have the meanings given in the Terms of Use.
By accessing or using the Platform, you acknowledge that you have read and understood this Privacy Policy.
2. Information We Collect
2.1 Information You Provide Directly
Depending on how you use the Platform, we may collect:
Account Information: name, email address, phone number, mailing address, login credentials
Applicant Information: resumes, work history, certifications, education, references, availability, profile photos, and application responses
Provider Information: onboarding details, identity verification information, tax forms (e.g., W-9), payment account details, background check documentation (where applicable), time entries
Customer Information: business name, contact details, billing information, job postings, hiring decisions, communications
Communications: messages sent through the Platform, emails, support requests
You are responsible for ensuring the accuracy of the information you submit.
2.2 Information Collected Automatically
When you access the Platform, we may automatically collect:
IP address
Device identifiers
Browser type and operating system
Log data (pages viewed, actions taken, timestamps)
Approximate location (derived from IP)
We use cookies and similar technologies to support Platform functionality, analytics, and security.
2.3 Information from Third Parties
We may receive information from third parties, including:
Payment processors (e.g., Stripe)
Identity verification or background check providers (where permitted by law)

Customer-provided information about Applicants or Providers
3. How We Use Information
Separation of Hiring and Marketplace Data
Information submitted by Applicants through Upkid’s applicant tracking and hiring tools is used solely to facilitate Customers’ hiring workflows. Applicant information is not used to enroll individuals into Upkid’s service provider marketplace or to offer service assignments unless and until the individual separately registers, affirmatively consents, and completes onboarding as a Provider. Any transition from Applicant to Provider requires explicit user action and acceptance of applicable Provider terms.
Upkid does not sell Applicant data and does not use Applicant data for advertising, solicitation, marketing, or promotion of Upkid’s service provider marketplace.
We use personal information to:
Operate, maintain, and improve the Platform
Facilitate applicant tracking, hiring, staffing, and workforce management workflows
Enable Providers to review and accept opportunities
Process payments and related transactions
Communicate with users about accounts, updates, and support
Enforce our Terms of Use and policies
Detect, prevent, and investigate fraud, abuse, or security issues
Comply with legal and regulatory obligations
Upkid does not sell personal information.
4. How Information Is Shared
4.1 Sharing Between Platform Users
Applicants → Customers: Information submitted through applications or profiles may be shared with Customers to facilitate hiring decisions.
Providers → Customers: Provider profile and work-related information may be shared with Customers in connection with accepted opportunities.
Customers control hiring decisions and workplace conditions.
4.2 Service Providers
We may share information with trusted service providers who perform services on our behalf, such as:
Payment processing
Cloud hosting
Analytics
Customer support
Identity verification and compliance services
These providers are contractually required to protect information and use it only as permitted.
4.3 Legal and Business Transfers
We may disclose information:
To comply with legal obligations, subpoenas, or lawful requests
To protect the rights, safety, and property of Upkid or others
In connection with a merger, acquisition, financing, or sale of assets
5. Independent Contractor Clarification
Providers who perform services through the Platform do so as independent contractors, not employees of Upkid. Upkid does not control how Providers perform services. This Privacy Policy does not create an employment relationship.
6. Data Retention
We retain personal information for as long as reasonably necessary to:
Provide the Platform
Comply with legal, tax, and accounting obligations
Resolve disputes and enforce agreements
Retention periods vary based on data type and legal requirements.
7. Data Security
We implement reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no system is completely secure, and we cannot guarantee absolute security.

Depending on your location, you may have rights to:
